These Terms and Conditions ("Agreement") govern your access to and use of the services provided by Trestio LLC ("Trestio," "we," "us," or "our"). By purchasing any Trestio service, checking an agreement box at checkout, signing an order form, or otherwise using Trestio's platform, you confirm that you have read, understood, and agree to be bound by this Agreement in full.

If you do not agree to these terms, do not use or purchase Trestio's services.

02 Acceptance of Terms

By purchasing, subscribing to, or using any Trestio service, you represent and warrant that:

  • You have read and understood these Terms and Conditions in their entirety
  • You have the legal authority to enter into this Agreement on behalf of yourself or the business entity you represent
  • You agree to be bound by all terms, conditions, and policies referenced herein, including Trestio's Privacy Policy and any applicable order form or statement of work
  • You accept the No Refund Policy described in Section 8
  • You waive any right to initiate a chargeback for services rendered as described in Section 9

This Agreement is entered into as of the date you first access or purchase a Trestio service ("Effective Date").

03 Description of Services

Trestio LLC provides business infrastructure services to local service businesses operating in the United States. Services may include, but are not limited to:

  • Lead capture website design and build
  • Website widget and chat infrastructure
  • All-in-one inbox and communication management tools
  • Dedicated business phone number and the Trestio App
  • Automated lead follow-up sequences
  • Missed call text back
  • AI Chatbot configuration
  • AI Receptionist (inbound call handling, available as an add-on)
  • 5-Star AI Review and Referral Flywheel
  • Customer Re-Engagement Campaigns (one-time, available as an add-on)
  • Google Business Profile setup, rebuild, or optimization (available as an add-on)
  • On-site SEO implementation (build-time only)
  • Calendar booking and payment collection (future phase)
  • Platform hosting, maintenance, and system upkeep

Trestio is an infrastructure company. We do not provide marketing management, advertising services, growth guarantees, lead generation, or performance promises of any kind. Trestio does not guarantee specific outcomes including but not limited to leads generated, revenue earned, calls received, or search rankings achieved.

Services are delivered through the GoHighLevel platform ("GHL") and configured within a sub-account managed by Trestio on behalf of the client. Trestio reserves the right to modify the technical delivery stack, provided equivalent functionality is maintained.

04 Eligibility

Trestio's services are available exclusively to businesses and business owners operating in the United States. By using our services, you confirm that:

  • You are at least 18 years of age
  • You are acting on behalf of a legitimate business entity or as a sole proprietor engaged in lawful commercial activity
  • You have the authority to bind your business to this Agreement
  • Your business is based in and serves customers within the United States

Trestio reserves the right to decline service to any prospective client at our sole discretion.

05 Subscription Plans and Billing

5.1 Available Plans

Trestio offers subscription plans that vary in the scope of services and features included. The specific plan you are enrolled in, along with the applicable monthly fee, will be stated in your service agreement at the time of purchase. Current plan options and pricing are available at trestio.com/pricing.

5.2 Billing Terms

  • All subscription fees are billed in advance of the service period on a monthly basis.
  • Subscriptions automatically renew on the same day each month until cancelled by the client in accordance with Section 10.
  • Payment is collected by credit or debit card through Stripe, our secure third-party payment processor. By subscribing, you authorize Trestio to charge your card on file on each renewal date.
  • All fees are stated and charged in US dollars.

5.3 Commitment Incentives

Trestio may offer commitment-based incentives including prepaid terms with associated bonuses or waived fees. Where such an incentive includes a waived one-time fee, early cancellation before the full committed term results in that waived fee becoming immediately due and payable. The specific terms of any commitment incentive are confirmed in your service agreement at the time of sale.

06 Setup Fees

Certain Trestio plans and add-on services may include a one-time setup fee to cover the cost of onboarding, building, and configuring your system. Whether a setup fee applies, and the amount if so, will be clearly stated in your service agreement before purchase. Not all plans or promotions include a setup fee.

Where a setup fee applies, it is collected at the time of purchase. Setup fees become non-refundable once the onboarding process has commenced. The onboarding process is deemed to have commenced upon: collection of your completed onboarding form, or initiation of the first onboarding call, whichever occurs first — except as provided under the cooling-off period in Section 8.

07 Usage-Based Charges

Certain communication services consumed through the Trestio platform — including but not limited to SMS messages, voice calls, phone number provisioning, and number lookup functions — may incur usage-based charges depending on your plan and configuration.

Whether usage-based charges apply to your account, and the applicable rates if so, will be clearly disclosed in your service agreement prior to activation. Trestio will not apply usage-based rebilling to your account without informing you in advance. If your plan includes rebillable usage, your account will maintain a digital wallet balance that is automatically replenished as usage occurs, based on your selected preferences.

Usage rates are determined in part by underlying carriers and platform providers and may be subject to change. Where material rate changes apply to active accounts, Trestio will provide advance notice.

08 Refund Policy

8.1 24-Hour Cooling-Off Period

If you change your mind after purchasing a Trestio service, you may request a full refund of all amounts paid within 24 hours of your initial payment, with no questions asked. To request a refund under this provision, email [email protected] with your name and the subject line "Refund Request" within 24 hours of purchase. Refunds under this provision are processed within 5–10 business days to your original payment method.

8.2 After the Cooling-Off Period

After the 24-hour cooling-off period has passed, all payments are final and non-refundable. This includes monthly subscription fees, setup fees (where applicable), usage charges, and any one-time service fees. By continuing beyond the 24-hour window, you acknowledge that:

  • Trestio's services are custom-built and resources are allocated to your account from the moment onboarding begins
  • Delivery is considered to have commenced once the onboarding process starts, and is non-reversible
  • Cancellation of a subscription stops future charges but does not entitle you to a refund of any amounts already paid
  • No partial refunds are available for unused portions of a billing period

8.3 Exceptions

Trestio reserves the right to issue refunds at its sole discretion in cases of documented material failure on our part to deliver the agreed service. Any such determination is made by Trestio on a case-by-case basis and does not create a general entitlement to refunds.

09 Chargebacks

By accepting these terms, you expressly agree not to initiate a chargeback, credit card dispute, or payment reversal with your bank or card issuer for any charges made by Trestio LLC for services rendered under this Agreement.

You understand and agree that:

  • Initiating a chargeback constitutes a material breach of this Agreement
  • Trestio reserves the right to submit evidence of this Agreement, your acceptance of these terms, platform usage logs, delivery documentation, and communication records to any payment processor, bank, or card network in response to any dispute
  • If a fraudulent or unwarranted chargeback is filed, Trestio may pursue recovery of the full amount owed plus any chargeback fees, administrative costs, and reasonable legal or collection fees
  • Trestio may suspend or permanently terminate your account upon receipt of a chargeback

If you have a billing concern or believe an error has been made, you must contact us directly at [email protected] before initiating any dispute with your payment provider. Trestio will review all legitimate billing concerns in good faith.

10 Cancellation

10.1 How to Cancel

You may cancel your Trestio subscription at any time by contacting us at [email protected]. Cancellation requests must be submitted in writing and will be confirmed by Trestio within 3 business days.

10.2 Cancellation Effective Date

Cancellation takes effect at the end of the current billing cycle. You will retain access to your platform through the end of the paid period. No further charges will be made after the cancellation is processed, unless usage-based charges have accrued in your wallet.

10.3 Effect of Cancellation

Upon cancellation:

  • Your platform access will be deactivated at the end of the billing period
  • Trestio-built website and system assets will be taken offline
  • Any outstanding wallet balance for usage charges remains due and payable
  • No refund is issued for any unused portion of the billing period
  • If you are within a committed annual term and have received a waived fee under a commitment incentive, that waived fee becomes immediately due upon early cancellation

10.4 Data After Cancellation

Client data including contact records, conversation history, and system configurations will be retained for 30 days after cancellation, during which time you may request an export. After 30 days, data will be permanently deleted.

11 Delivery of Services

Services are considered rendered and fulfilled once:

  • The client's website has been completed and delivered to the registered domain
  • Platform infrastructure, automations, and system components have been configured and activated within the client's GoHighLevel sub-account
  • The client's onboarding call has been completed and system access credentials have been provided

A launch walkthrough call is included as part of onboarding. However, completion of the launch call is not a prerequisite for services being considered delivered. If a client is unresponsive to scheduling the launch call, the service is still considered delivered once the platform is live and accessible.

Estimated delivery timelines are provided as guidance only and are subject to the timely receipt of required information from the client (including domain access, logo, phone number, and onboarding form completion). Delays caused by the client's failure to provide required information do not entitle the client to a refund or service extension at no charge.

12 Website Edits and Change Policy

12.1 Included Monthly Edits

Each subscription plan includes a monthly allocation of minor website edits submitted as a single batch request:

  • Essential System: 1 batch of minor edits per month
  • Growth System: 2 batches of minor edits per month

A "batch" means all requested edits must be submitted together in a single written request. Requests submitted separately or incrementally count as separate batches and may be applied against future months' allocations or billed as additional batches.

12.2 What Counts as a Minor Edit

Minor edits include: text changes or corrections, image replacements, CTA wording changes, small layout or spacing adjustments, and section-level tweaks that do not require structural changes to the page.

12.3 What Is Not Included

The following are not minor edits and are not included in monthly allocations:

  • New page creation
  • Full redesigns or visual rebranding
  • Structural layout changes across multiple pages
  • Copy rewrites or messaging strategy work
  • Automation or workflow changes beyond minor text adjustments

12.4 Additional Work Pricing

Requests that fall outside your plan's included edit allocation, including additional edit batches, new page creation, and full redesigns, are available at additional cost. Applicable rates will be provided upon request and confirmed before any out-of-scope work begins.

13 SMS and Messaging Terms

These SMS terms apply to all text message communications sent and received as part of Trestio's A2P 10DLC messaging services.

13.1 SMS Disclosure

By opting in to Trestio's SMS services, you agree to receive text messages related to notifications, marketing offers, account authentication (2FA), and other service-related communications. Message frequency may vary. Standard message and data rates apply according to your mobile carrier's terms.

Your mobile opt-in data will not be shared with third parties for their marketing purposes under any circumstances.

13.2 Opt-Out

Reply STOP to any Trestio message to unsubscribe from SMS communications at any time. You will receive one final confirmation message and no further messages will be sent.

13.3 Help

Text HELP to any Trestio message or email [email protected] for support.

13.4 Message Delivery

Trestio does not guarantee that messages will be delivered without delays or failures. Such issues can occur due to network problems, device compatibility, or carrier restrictions outside our control.

13.5 User Obligations for Messaging

When using Trestio's messaging infrastructure, clients are solely responsible for ensuring their use of the messaging system complies with all applicable laws and regulations including the TCPA, CAN-SPAM Act, and applicable carrier guidelines. Clients must not use Trestio's messaging tools to send spam, unsolicited messages, or communications that harass, threaten, or harm recipients. Clients are responsible for obtaining and maintaining valid consent from all contacts in their database.

13.6 A2P 10DLC Compliance

Trestio operates SMS campaigns under the A2P 10DLC framework. Clients acknowledge that use of messaging services through the platform is subject to carrier registration requirements and that messages may be filtered or blocked by carriers if compliance standards are not met. Trestio provides A2P campaign registration as part of the platform setup but is not liable for carrier-side filtering decisions.

14 Payment Failures and Account Suspension

If a payment fails, Trestio will attempt to process the payment up to 4 times over a period of approximately 3 weeks. If a failed payment is not resolved within 48 hours of the first failed attempt, your account and platform access may be suspended until the outstanding balance is paid in full.

During a suspension period:

  • Your website and platform automations may be deactivated
  • Incoming leads and communications may not be captured or routed
  • Subscription time continues to accrue during any suspension period, regardless of access status

Trestio is not liable for any business impact resulting from account suspension due to non-payment. To reinstate your account, you must pay all outstanding amounts in full.

15 Client Obligations

Clients are solely responsible for:

  • Responding to leads generated through or captured by Trestio's system
  • Answering calls, returning missed call notifications, or configuring call routing appropriately
  • Managing their own sales process and converting inquiries into booked jobs or revenue
  • Providing accurate and up-to-date business information for use in their system build
  • Ensuring their business holds all licenses, permits, and insurance required to operate legally
  • Complying with all applicable laws in their use of Trestio's platform and communications tools
  • Maintaining valid consent records for all contacts in their database to whom messages are sent via the platform

Trestio is not responsible for sales performance, revenue outcomes, missed opportunities caused by the client's failure to respond to leads, or any business decisions made by the client.

16 Intellectual Property

16.1 Trestio's Property

All templates, prompts, automation workflows, system configurations, and methodologies developed by Trestio LLC remain the intellectual property of Trestio LLC. These are licensed to clients on a non-exclusive, non-transferable basis for use during an active subscription. Upon cancellation, this license terminates.

16.2 Client's Property

Content, materials, branding, logos, and data provided by the client remain the property of the client. Trestio uses client-provided materials solely for the purpose of building and maintaining the client's system.

16.3 Platform Assets on Cancellation

Trestio-built website pages, configured automations, and platform assets deployed within the GoHighLevel sub-account are considered Trestio's work product and will be deactivated upon cancellation. Clients may request an export of their contact data and campaign content within 30 days of cancellation.

17 Limitation of Liability

To the maximum extent permitted by applicable law, Trestio LLC, its members, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, loss of business, or loss of goodwill, arising out of or in connection with this Agreement or your use of Trestio's services, even if advised of the possibility of such damages.

In no event shall Trestio's total cumulative liability to you for any claims arising out of or related to this Agreement exceed the total amount paid by you to Trestio in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

18 Disclaimer of Warranties

Trestio's services are provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Trestio does not warrant that:

  • The service will be uninterrupted, error-free, or completely secure
  • Any specific results, leads, revenue, rankings, or outcomes will be achieved
  • Third-party platforms (including GoHighLevel, Google, Meta, or any carrier) will operate without interruption, policy changes, or service degradation

You use Trestio's services at your own risk. Trestio is not a marketing agency and does not make performance guarantees of any kind.

19 Indemnification

You agree to defend, indemnify, and hold harmless Trestio LLC and its members, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of Trestio's services in violation of this Agreement or applicable law
  • Your use of the messaging platform in violation of TCPA, CAN-SPAM, or applicable carrier guidelines
  • Content or materials you provide to Trestio that infringe the intellectual property or other rights of any third party
  • Any claim by a third party arising from your business operations or communications with your customers
  • Any fraudulent chargeback or payment dispute you initiate in violation of Section 9

20 Governing Law and Disputes

20.1 Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

20.2 Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact Trestio at [email protected] to attempt to resolve the dispute informally. Trestio will make a good-faith effort to resolve all legitimate concerns within 15 business days.

20.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Wyoming. The arbitrator's decision shall be final and binding. Each party shall bear its own costs unless the arbitrator determines otherwise.

20.4 Class Action Waiver

You agree that any arbitration or legal proceeding arising under this Agreement shall be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against Trestio.

20.5 Jurisdiction for Injunctive Relief

Notwithstanding the arbitration provision, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Wyoming to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations.

21 Changes to These Terms

Trestio reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated to active clients via email at least 14 days before taking effect. Non-material changes (such as clarifications, formatting updates, or corrections) may be made without prior notice.

The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of Trestio's services after any changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, your sole remedy is to cancel your subscription in accordance with Section 10.
